These Terms of Use ("Terms") govern your use of the Topes Tones mobile application ("the App") operated by Todd Topor ("we," "us," or "our"). By downloading, installing, or using Topes Tones, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use Topes Tones. If you are under 18, you must have permission from a parent or guardian. By using the App, you represent that you meet these requirements.
You may create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us if you believe your account has been compromised.
Pro Caddy ($4.99/month): An auto-renewable subscription that unlocks all premium content. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your iPhone's Settings → Apple ID → Subscriptions.
Lifetime Club ($49.99): A one-time purchase that permanently unlocks all premium content, including all future tone packs. Includes Family Sharing.
All purchases are processed by Apple. Refund requests should be directed to Apple at reportaproblem.apple.com.
You may record and upload audio content ("Tones") through the Custom Tones Studio and share them via the Community Exchange. By uploading content, you:
You retain ownership of your original content. You may delete your uploaded tones at any time.

Violations may result in content removal, account suspension, or permanent ban at our sole discretion.
We reserve the right to review, remove, or disable access to any user-generated content that violates these Terms or our Community Rules, without prior notice. We are not obligated to monitor all content but may do so at our discretion.
The App, including all built-in tones, graphics, logos, icons, and software, is the property of Todd Topor and is protected by copyright and trademark laws. You may not copy, distribute, or create derivative works from any part of the App without our written permission.
Topes Tones is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Use the App at your own risk.
To the maximum extent permitted by law, Todd Topor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.
We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (such as intellectual property rights and limitation of liability) will remain in effect.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
